Judge Cannon Blocks Jack Smith Report

In a significant legal ruling with national implications, U.S. District Judge Aileen Cannon (Judge Cannon) has permanently blocked the public release of a report prepared by Special Counsel Jack Smith, concluding that disclosure would violate legal protections and exceed the scope of federal authority.

The decision, issued Monday from the U.S. District Court for the Southern District of Florida, bars the Department of Justice from publishing or disseminating the report, which detailed findings from Smith’s investigation into former President Donald Trump. The investigation had examined Trump’s handling of classified documents and related conduct following the 2020 election. “A federal judge on Monday agreed to permanently block the release of volume two of former special counsel Jack Smith’s report — centered on President Donald Trump’s handling of classified materials after his first term in office — in a significant victory for the president and his co-defendants,” according to FOX News.

In her written order, Judge Cannon determined that releasing the report would risk prejudicing ongoing legal matters and infringe upon due process protections. Cannon had essentially also determined that while special counsels can submit confidential reports to the attorney general, there is no requirement that is currently in place to make those documents readily available to the public.

Many of the transparency advocates were calling for the Justice Department to release the report in the interest of accountability within the public eye as a whole.  Supporters of disclosure argued that voters deserve to understand the conclusions of a high-profile federal investigation involving a former president and current political figure. ““Judge Cannon’s courage and judicial resolve on these important due process issues should be recognized and taught in law school classrooms across America,” Trump’s lawyer Kendra Wharton said in response to the ruling,” according to Politico News.

However, attorneys for Trump had filed motions seeking to block publication, contending that the report contained unproven allegations and could taint potential jurors. They had argued that making the findings completely public would undermine the rights that are given to Trump as a whole.

The Justice Department had previously signaled its intent to release at least portions of the report, consistent with past practice following special counsel investigations. The department has not yet indicated whether it will appeal Cannon’s ruling to a higher court.

Many of the analysts are saying the case could have much broader ramifications for how special counsels are handled in the near future.
